Robert S. Marcus founded our law office in 1977. In 1992, he was joined by fellow trial lawyer Jonathan B. Mack and then by a team of valued associates. Bryan S. Neiderhiser was named a partner in the firm in 2018. Together, they lead our efforts to protect the rights of people injured in serious accidents who are struggling to rebuild their lives.

Significant Cases

  • Mr. Frederick prepared and argued, in the Superior Court of Pennsylvania, the seminal case Shiner v. Ralston, 2013 PA Super 33, 64 A.3d 1 (Pa. Super. Ct. 2013), which established the Sudden Medical Emergency Defense for the first time in Pennsylvania.
  • Mr. Frederick scored a significant victory when the United States Court of Appeals for the Third Circuit vacated a district court's order dismissing a proposed consumer rights class action lawsuit against Ambit Energy.  In Silvis v. Ambit Energy, et al., Defendant Ambit Energy is accused of charging exorbitant electricity rates and breaching its contract with Ms. Silvis and the Proposed Class by failing to set its rates based on the factors outlined in its contract.  Because of this significant victory in the Third Circuit, Ms. Silvis' lawsuit will proceed with the goal of securing a just result for Ms. Silvis and thousands of potential class members across Pennsylvania. Troy M. Frederick represents Ms. Silvis and the proposed class. Read the entire opinion here.
  • Mr. Frederick is currently litigating numerous multi-state class actions, encompassing hundreds of thousands of people, against Electric Generation Suppliers for breaking their contracts with customers by overcharging them for electricity by more than 300% in some cases.
  • Mr. Frederick is co-counsel in a proposed nationwide class action/multidistrict litigation, filed in the United States District Court for the District of Colorado, against Air Methods Corporation and Rocky Mountain Holdings, LLC, related to alleged overcharging for emergency medical helicopter transport. In many instances, victims have been billed more than $47,000 for less than 100 miles of emergency medical helicopter transportation.
  • Mr. Frederick is lead counsel in a proposed class action lawsuit against REA Energy Cooperative, Inc. for refusing to return tens of millions of dollars of patronage capital to its current and former electric customers/members.
  • Mr. Frederick is pleased to announce that a $1,250,000 settlement has been reached in a class action lawsuit against U.S. Gas & Electric, Inc., Energy Services Providers, Inc., and Pennsylvania Gas & Electric (collectively, "PAG&E"). The case is caption is: Sobiech v. U.S. Gas & Electric, Inc., United States District Court Eastern District of Pennsylvania, Civil Action No. 2:14-cv-04464. Marcus & Mack represents the plaintiff in this case, and Mr. Frederick has been appointed Class Counsel representing all class members. Plaintiff alleges that Defendants' acts and omissions in connection with its electric energy supply activities in Pennsylvania constitute breach of contract and breach of the covenant of good faith and fair dealing and warrant declaratory relief and damages as a result.
  • Mr. Frederick is pleased to announce that an approximately $9,300,000 settlement, at a 100% claims participation rate, has been reached, pending final Court approval, in a class action lawsuit against Ambit Northeast, LLC. The case caption is: Silvis v. Ambit Energy, L.P., et al., United States District Court Eastern District of Pennsylvania, Civil Action No. 14-cv-5005. Marcus & Mack represents the plaintiff in this case, and Mr. Frederick has been appointed Class Counsel representing all class members. Plaintiff alleges that Defendant’s acts and omissions in connection with its electric energy supply activities in Pennsylvania constitute breach of contract and breach of the covenant of good faith and fair dealing and warrant declaratory relief and damages as a result.
  • Mr. Frederick is pleased to announce that a class action settlement has been reached, pending final Court approval, in a class action lawsuit against IDT Energy, Inc. The settlement is valued in excess of $60,000,000 at a 100% all credit claims made rate. The case caption is: McLaughlin v. IDT Energy, Inc. et. al., United States District Court Eastern District of New York, Civil Action No. 14-cv-4107. Marcus & Mack represents plaintiff Ferrare in this case, and Mr. Frederick has been appointed Co-Class Counsel representing all class members. Plaintiff alleges that Defendants’ acts and omissions in connection with their electric energy supply activities in Pennsylvania constitute breach of contract and warrant declaratory relief and damages as a result.
  • Mr. Frederick is pleased to announce that a class action settlement has been reached, pending final Court approval, in a class action lawsuit against Stream Energy Pennsylvania, LLC.  The settlement is valued at approximately $10,000,000 at a 100% claims made rate. The case caption is: Basile v. Stream Energy Pennsylvania, LLC, United States District Court Middle District of Pennsylvania, Civil Action No. 15-cv-01518. Marcus & Mack represents Mr. Basile in this case, and Mr. Frederick has been appointed Interim Class Counsel representing all class members. Plaintiff alleges that Defendant’s acts and omissions in connection with its electric energy supply activities in Pennsylvania constitute breach of contract and warrant declaratory relief and damages as a result.
